Nkabinde Inquiry Delayed As NDPP Shamila Batohi Insists On Legal Counsel Before Testifying

in Africa

The Nkabinde Inquiry, which was established to investigate the fitness of Advocate Andrew Chauke to hold office, has faced yet another setback. National Director of Public Prosecutions (NDPP) Advocate Shamila Batohi has declined to resume her testimony until she is provided with legal representation. This issue, which first surfaced in December 2025, has once again come to light on 26 January 2026.

The Nkabinde Inquiry was initiated in response to serious allegations made against Advocate Chauke, who was appointed as the Director of Public Prosecutions in KwaZulu-Natal in 2023. These allegations include claims of misconduct, abuse of power, and failure to properly execute his duties. As a result, the inquiry was launched to determine whether Advocate Chauke is fit to continue serving in his position.

The inquiry has been ongoing for over a year now, and it has been met with numerous delays and challenges. However, the recent development of Advocate Batohi refusing to testify without legal representation has caused further delays and raised concerns about the progress of the inquiry.

According to Advocate Batohi’s legal team, she has raised concerns about her personal safety and the potential legal implications of her testimony. They have stated that she is not willing to testify without proper legal representation to protect her rights and interests.

This decision has been met with mixed reactions, with some questioning the motive behind Advocate Batohi’s request for legal representation. However, it is important to note that she has the right to legal counsel, and it is crucial that her rights and interests are protected during the inquiry.

The Nkabinde Inquiry has already been marred with controversies and delays, and it is essential that all parties involved work together to ensure a fair and transparent process. The decision to appoint Advocate Batohi as the NDPP was met with high expectations, and it is vital that she is given the necessary support to fulfill her duties effectively.

It is also worth noting that Advocate Batohi’s role in the inquiry is crucial, as she is expected to provide valuable insights and information regarding Advocate Chauke’s fitness to hold office. Her testimony can potentially have a significant impact on the outcome of the inquiry and the future of Advocate Chauke’s career.

Therefore, it is imperative that Advocate Batohi is given the necessary legal representation to ensure that she can testify without any fear or bias. The delay in her testimony may be frustrating, but it is crucial for the integrity and fairness of the inquiry.

It is also essential to remember that the Nkabinde Inquiry is not just about one individual; it is about upholding the integrity and credibility of the National Prosecuting Authority (NPA). The NPA plays a crucial role in the justice system, and it is vital that its leaders are held to the highest standards of integrity and professionalism.

In conclusion, the Nkabinde Inquiry has faced yet another delay, with Advocate Batohi insisting on legal representation before testifying. While this may cause frustration and further delays, it is crucial that her rights and interests are protected during the inquiry. The NPA is a vital institution in our justice system, and it is essential that its leaders are held accountable for their actions. Let us hope that this issue is resolved soon, and the Nkabinde Inquiry can continue its important work.
