Illinois Passes Law Preventing ICE Arrests in Courthouses

November 2, 2025
in Americas

In a move to protect the rights and safety of illegal immigrants, Illinois lawmakers have passed a bill that prohibits federal immigration agents from making arrests near and around state courthouses. This decision, which was made on Friday, makes Illinois the third Democrat-run state to take a stand against the controversial actions of the Immigration and Customs Enforcement (ICE).

The bill, which was introduced by Democratic Senator Iris Martinez, aims to provide a safe and secure environment for all individuals seeking justice in the state’s courthouses. It specifically prohibits federal immigration agents from making arrests within 100 feet of any state court building or while court proceedings are taking place. This means that individuals, regardless of their immigration status, can attend court hearings without fear of being detained by ICE.

This decision comes at a time when the Trump administration’s immigration policies have sparked widespread controversy and fear among immigrant communities. The aggressive tactics used by ICE, including making arrests in sensitive locations such as schools, hospitals, and now courthouses, have caused outrage and concern among many.

The passing of this bill in Illinois sends a strong message that the state is committed to protecting the rights and safety of all individuals, regardless of their immigration status. It also serves as a reminder that state laws and policies can be used to counter the federal government’s actions and protect the interests of its residents.

Senator Martinez, who has been a vocal advocate for immigrant rights, stated that the bill was necessary to ensure that individuals can access the justice system without fear of retaliation from federal immigration agents. She also emphasized that the bill does not prevent ICE from carrying out their duties, but rather sets boundaries to protect the rights of individuals seeking justice.

The decision to pass this bill has been met with praise and support from immigrant rights groups and advocates. The Illinois Coalition for Immigrant and Refugee Rights (ICIRR) called it a “victory for justice and fairness” and a step towards creating a more welcoming and inclusive state.

This move by Illinois follows similar decisions made by New York and New Jersey, both of which have also passed laws preventing ICE arrests in courthouses. It is a clear indication that states are taking action to protect their immigrant communities and uphold the values of justice and fairness.

While some may argue that this bill goes against federal immigration laws, it is important to remember that states have the right to pass laws that protect the well-being of their residents. This bill does not prevent ICE from carrying out their duties, but rather sets boundaries to ensure that individuals can access the justice system without fear of being detained.

In a time where the immigration debate has become increasingly polarized, it is refreshing to see states taking a stand to protect the rights of all individuals. This decision by Illinois lawmakers serves as a reminder that the values of justice, fairness, and compassion should always prevail in our society.

In conclusion, the passing of this bill in Illinois is a positive step towards creating a more inclusive and welcoming state for all individuals. It sends a strong message that Illinois is committed to protecting the rights and safety of its residents, regardless of their immigration status. Let us hope that other states will follow suit and prioritize the well-being of their immigrant communities.
